PREAMBLE

It is accepted that a Shopper contracted by Customer Brand Services Pty Ltd (CBS) will collect some confidential information from CBS and/or their clients in the course of conducting assignments.

In agreement to this PRIVACY POLICY & CONFIDENTIALITY STATEMENT the CBS Shopper acknowledges that CBS' reputation and business requires the Shopper to strictly adhere to this agreement and damages alone would not be sufficient remedy for breach by the Shopper. If the Shopper breaches this Agreement, CBS may enforce all legal rights available to it, including injunctions and claims for damages (compensation).

CBS reserves the right to exclude Shoppers from engaging in current or future CBS assignments and/or de-register the Shopper with CBS.

Changes to CBS Policy information will be updated on the CBS website and detailed in monthly CBS newsletters.

PRIVACY & CONFIDENIALITY

CBS not only respects, but protects, the right to privacy of our Clients and our Shoppers. No Shopper personal information whatsoever will be knowingly passed onto any third party by CBS.

As a registered Shopper you automatically authorise CBS to utilise SMS and email communication at anytime as deemed appropriate by CBS management. CBS may email you with promotional material from time to time. If a Shopper does not wish to receive these emails the Shopper may de-register from the CBS database at any time.

Under no circumstances is any information supplied by CBS or gained during the assignment to be released or made available to any third party, whether knowingly or accidentally. If CBS requests, the Shopper will immediately send to CBS all notes, papers, writings, computer records, summaries, etc relating to the Shopper's assignments.

As a CBS Shopper you must not share information with others on CBS' clients including but not limited to information with others on assignment fees and reimbursements for specific clients. You may not share the results of an assignment.

CBS need to ensure that all information gained by the Shopper is accurate and complies with Equal Employment Opportunity (EEO) law. EEO law was developed to ensure that all people have an equal opportunity to gain or retain employment.

Information relating to health, communicable diseases, history of mental or psychiatric conditions, disability, sexual orientation, records of criminal convictions, ethnicity or Aboriginality are examples of details that must not be detailed in any report unless the information is directly relevant to the assignment. CBS and the Shopper may be liable for the provision of any information to a client that inappropriately discriminates against an employee.

CONFLICTS OF INTEREST

A Shopper must not ask or encourage anyone to break confidentiality agreements with other firms for whom they conduct assignments. At no time may a Shopper contact a client directly in relation to CBS business without the explicit approval of CBS.

  • At no time may a Shopper accept an assignment if the Shopper has worked or is presently working for the Client being shopped by CBS.
  • At no time is a CBS Shopper to accept an assignment if the Shopper works for the competitor of the client requesting the assessments.
  • At no time is a CBS Shopper to accept an assignment if the Shopper knows or is related to any staff members where the assignment is taking place.
  • At no time is a CBS Shopper to accept an assignment if they have had a past negative experience with the client company.
  • A Shopper must not use any media to publish complaints against CBS, clients, or other Shoppers.

CONDUCT

As a Shopper you agree to perform all assignments with honesty and integrity. All assignment reports must be submitted on or before the deadline. CBS require Shoppers give immediate notice to CBS if they cannot perform an assignment for any reason. Contact or follow-up calls or emails are to be responded to in a timely manner;

A Shopper must not perform a shop unless they have thoroughly read each question in the survey and the guidelines provided by the assignment provider. A Shopper must not falsify or misrepresent reports. All paperwork and notes must be kept for a period of no less than 60 days.

At no time is A CBS Shopper to make deliberate misrepresentation or encourage dishonesty or deliberately irritate a target employee or be a deliberately difficult Shopper. You must not disrupt the normal business flow of a client operation in the process of performing an assignment.

TAXATION & EMPLOYMENT

All Shoppers who accept assignments for CBS are classed as "suppliers" as requirements specified by the Australian Taxation Office. You are independently contracted to supply a discrete service for CBS not as an employee of CBS. Shoppers agree that nothing in this agreement (or related to this agreement) makes you an employee of CBS or makes you an agent or partner of CBS or any of its related entities or officers. You may not list CBS as an 'employer' on any forms (especially unemployment forms).

At all times, you remain independently contracted and, as such, to the extent permissible by law, CBS has no obligations in respect of annual leave, sick leave, long service leave, superannuation, workers' compensation, taxes, accident, sickness and life insurance for yourself. CBS has no responsibility to pay you or anyone associated with you for any of these things. Likewise, to the extent permissible by law, CBS has no responsibility to pay you or on your behalf wages, superannuation or any other contributions that employers pay including (amongst other things) payroll tax and workers' compensation premiums.

You do not have any authority to agree to anything on CBS's behalf or to bind CBS to any agreement or arrangement or understanding. You are not entitled to act as an agent or employee of CBS and must not do anything which would lead any reasonable person to think the contrary.

HEALTH & SAFETY

All Shoppers MUST complete the CBS induction program incorporating OH&S before commencement of any assignment.

At not time may you perform any shops under the influence of illegal drugs, or prescription drugs that might impair your abilities.

CBS is NOT liable for any events of personal injury or liability caused by or experienced by the Shopper whilst completing assignments on behalf of Customer Brand Services.

MYSTERY SHOPPING

A CBS Mystery Shopper must not announce themselves’ as a Mystery Shopper to the client business being shopped unless given specific instructions to do so by CBS. If a target employee asks the Shopper "Are you a Mystery Shopper" the Shopper is to plead ignorance.
